Thank you for using Dairy Plus. We are sure you will find the use of Dairy Plus convenient and easy.

Please read our terms of service carefully prior to using the website OR mobile application, do not use the website or mobile application if you do not agree to these terms.

For Customers:

By using this website i.e. www.dailyplus.app or Mobile Applications, or by telephonic order the user accepts, without limitation or qualification, the Terms of Services set out below and any additional Terms of Services set out in any sub-site. If you do not agree to these Terms of Services, you should exit the website.

We will notify users of any material changes to the Terms and Conditions by publishing a notice of such changes.

Terms of Services:

1. Your selection of the Dairy Plus should be based on the fact that the Dairy Plus services your addresses and your comfort with the services offered. www.Dairyplus.in and it’s holding company Quadspect does not prompt or force you to choose a specific retailer. The registered retailers specify their own services terms and conditions that are mentioned on the Dairy Plus’s or retailer’s specific web store.

2. Asks places by you:

Any Asks placed by you for goods listed or advertised on our website is an offer by you to purchase the goods selected in your order. No contract exists between you and us for the sale of any goods. We will send you an asks acknowledgement shortly after you place your order, notifying you that we have received your asks. This acknowledgement is not notification that we have accepted your order. Your order is passed to your retailer without any delays, however the acceptance of the asks is at the discretion of your chosen Dairy Plus retailer.

3. Cancellation Policy:

We will allow cancellation of any type of ‘ask’ before retailer accepts or will be governed by the retailer business operation hours. If you would like to cancel a retailer accepted ‘ask’, you would need to contact DailyPlus support at mailto:care@dailyplus.app resolution of which will subject to the type of ‘ask’ and retailer business hours. In out of stock scenarios, retailer might decline the ‘ask’ and provide alternative brand availability suggestion to you which you can accept at your sole discretion. System would auto-cancel your ‘ask’ in scenarios where retailer did not accepted before start time of the ‘ask’ and same will be notified to you. In the quest of constant improvement of our service, we might be collecting activity information to track efficiency of ‘ask’ process.

4. The contract:

While Dairy Plus enables placement of your order with your chosen retailer, there is no contract of services to be delivered between you and Dairy Plus. Your contract of goods to be delivered is with your chosen retailer and on the basis of specified terms and conditions of that specific retailer. The contract is subject to your right of cancellation. The retailer also has the right to terminate the contract if the due amount is not received from you.

5. Product description and other details:

We have taken care to describe and show items as accurately as possible. Despite this, slight variations in items may occur. Every effort is made to ensure that prices shown on Dairy Plus are accurate at the time of placing your order. However, at times the mentioned MRP on the website may vary from the prevailing MRP in the market place – in which case the MRP mentioned on the product pack would be considered to be the accurate MRP and the payments would need to be made by you basis that MRP to your chosen Dairy Plus retailer, however, you have the option of refusing to purchase the product if it does not meet your expectations.

6. Delivery charges:

The price of an item does not include the delivery charge. Charges, if any, would be charged directly by your chosen Dairy Plus retailer and the same would be specified by him in the stated terms and conditions and is dependent on delivery method you choose.

7. Delivery timings:

While you have an option to choose a time of delivery of your goods, the terms of agreement are between you and the retailer.

8. Product Quality:

Dairy Plus is not responsible for the quality of any available product. Any complaint of quality should be notified to the Retailer. He may choose to replace with new product.

9. Payment:

All payments would be made by you to your chosen retailer directly and only at the time of delivery and after you have verified and are satisfied with the goods delivered. www.Dairyplus.in and it’s affiliate websites we may collect payments on behalf of any retailers who are listed with Dairy Plus. If payment is not made to the retailer the retailer has the right not to fulfil your order.

You understand that the Payment System Providers and/or Card Association and/or your issuing bank may reject authentication and/or authorization of transaction placed by customer for any reason including but not limited to insufficient funds, incorrect authentication details provided, expired card/bank account, risk management, suspicion of fraudulent, illegal or doubtful transactions, selling of banned items, use of compromised cards or bank account numbers, use of banned/blacklisted cards or bank account numbers, use of suspicious API or in accordance with the RBI, Acquiring Banks, Issuing Institution and/or Card Association rules, guidelines, regulations, etc. and any other laws, rules, regulations, guidelines in force in India.

You further acknowledge that as a security measure we and/or the Payment System Providers may at our sole discretion, permanently or temporarily, block any card number, account numbers, group of cards or transactions from any specific blocked or blacklisted cards /, accounts, specific, group of IP addresses, devices, geographic locations and / or any such risk mitigation measures it wishes to undertake.

Once we received the payment, we provide the transaction confirmation and the same amount will be adjusted into your account within 3 hours.

There will be some cases, the transaction may not confirmed by the payment gateway. In these cases, we will closely work with payment gateway partner and resolve the issue. It may take 48 to 72 hours time to resolve the issue

If the transaction hasn’t gone through successfully, the amount will be refunded back to customer account within 15 days.

10. We (DailyPlus) shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any payment transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

11. Refund policy:

If you are eligible for a refund, the retailer will refund you your dues basis the contract between you and the retailer.

12. Warranty:

As such we don’t provide any warranty on the products but if any products having warranty as per product manufacturer policy please contact your retailer immediately after delivery of the products.

13. Products Damaged On Arrival:

In the unlikely event of you receiving goods that are damaged, please refuse the delivery and request your chosen retailer to replace with the correct item.

14. Wrong Item Delivered:

If, by mistake the retailer supplies you with the incorrect item you must notify him and ask for the same to be replaced with the correct item or refuse delivery by raising either customer ask thru Dairyplus APP or contact the retailer directly.

15. Liability Exclusions:

We do not have specific knowledge of your computer, your mobile device and its configuration. Whilst we will use our best efforts to minimize disruption to your system, we cannot be responsible for any unforeseen consequences of our services. Dairy Plus will not be liable for any damage to the laptop/desktop, loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages, however caused, before, during or after the use of our site. Dairy Plus will not be responsible or liable for any loss that is not reasonably foreseeable.

16. Confidentiality:

Dairy Plus agrees not to disclose any and all information or data files supplied with, stored on, or recovered from your equipment except to employees or agents of Dairy Plus subject to confidentiality agreements or as required by law.

17. Customer Notifications:

As a registered customer, you will receive notifications on any transaction such as billing or payments etc,. There will 3 type of notifications that system currently supports – SMS, Email and PNS (Phone and desktop Push notifications). You can opt-out of any of these notification at any point of time. If any problem in opting-out, please reach out to care@dailyplus.app.

We may periodically send promotional emails about new products, special offers or other information which we think you may find interesting using the email address which you have provided.

From time-to-time, we may also use your information to contact you for market research purposes. We may contact you by email, phone, fax or mail. We may use the information to customize the website/app according to your interests.

To contact you via email, phone or text message, to deliver certain services or information you have requested.

By using our Dairy Plus application(i.e. https://dailyplus.app, Android, Windows and ios applications), you acknowledge you have read and understood the terms of our Privacy Policy and that you accept and agree with it and consent to our processing of your personal data as set out in our Privacy Policy.

2. Availability and Faults:

Access to and use of our Website are provided and permitted on a temporary basis. The Website will not always be available and may have some faults.

We are under no obligation to update any information contained on our dairy plus application. We reserve the right to modify, edit, delete, suspend or discontinue, temporarily or permanently, our Website (or any portion or portions of it) and/or the information, materials, products and/or services available through our Website (or any portion or portions of it) with or without notice.

Our Website is provided on an “as is,” and “as available” basis, and to the extent permitted by law made without any guarantees, conditions or warranties of any kind.

3. Ownership:

Unless otherwise indicated, our Website including its design, text, content, arrangement, and other matters related to it are protected under copyright and other applicable intellectual property law and we are the owner or the licensee of all intellectual property and other proprietary rights in or relating to our Website. We therefore advise you to check information concerning a retailer with them or information concerning our products and services with us, and we are not liable for loss incurred by you from relying on information on the Website.

7. Pricing:

Dairy plus given the flexibility to retailer to modify or set the price for their products. Dairy plus not responsible for any errors or disputes arises in this regard.

8. Service charge or delivery charge collection from Customers:

9. Billing:

Retailer has to ensure to complete the below tasks before trigger or generate the bills.

   1. All the delivery information or sales transactions should be updated for the corresponding month (i.e. for the month which retailer wants to generate the bill)

   2. All the due amounts and payments should be adjusted or entered into the system for the corresponding month (i.e. for the month which retailer wants to generate the bill)

   3. Delivery charge or service charge amounts and system usage charges should be updated in the system either it should be global setting which applicable to all the customer or custom settings which can be applied for individual customer.

    4.All the Products price should be accurate

Dairy plus not responsible for any errors or disputes arises in the billing if retailer fails to fulfil the above steps.

10. Notifications:

As a registered customer, you will receive notifications on any transaction such as billing or payments etc,. 11. Payment:

In the event that you selected for online payment option, customers can pay their dues via online payment. There will be some gateway charges will be collected from customer for each transaction. The service charge details will be notified to customer based on customer chosen payment gateway option

The time taken to settle the amount to retailer account will be 3 days from the date of customer made the payment.

There will be some cases, where customer payments not confirmed by payment gateway. In these cases, the amount will be credited to retailer bank account after issue is resolved. It may take 7 to 10 days time to resolve the issue in this regard.

12. Our Fees:

You understand that you may be charged a fee with respect to your use of the Services. Further, we may also charge a fee with respect to certain optional valued added services that you elect to use. The amount of the fee will be displayed to you on the Dairy Plus page. You agree to pay all such fees and charges as may be applicable to the Services you use and authorize us to add the fee to the amount of the bill payment you request or bill you separately for such fees. We agree and accept that reserve the right to change the fee structure from time to time.

13. TERMINATION:

Our Right: We reserve the right, without notice and in its sole discretion, to terminate your access to, and use of, of the Services and to block or prevent your future access to, and use of, the Services. Upon termination, you must uninstall any copies of the Services from your computer and/or mobile or other devices. We will not be liable to you for the termination of the Services or for any consequence arising out of termination of the Services.

14. EFFECT OF TERMINATION:

We will not be liable to you for compensation, reimbursement, or damages in connection with your use of the Services, or any termination or suspension of the Services. Any termination of this Agreement does not relieve you of any obligations to pay any fees or costs accrued prior to the termination and any other amounts owed by you to us, and/or the Payment System Providers as provided in this Agreement.
